Almost every rent agreement in India runs for exactly 11 months. Not a superstition, not a convention β€” a deliberate step to stay one month under a registration rule.

Why 11 months

Under the Registration Act, a lease of immovable property from year to year, or for a term of one year or more, must be compulsorily registered. An agreement of 11 months sits just below that threshold, so it escapes the requirement and needs only adequate stamping and, usually, notarisation.

That saves the registration fee and the trip to the sub-registrar, which is how the 11-month tenancy became standard everywhere. It is perfectly legal. It just means the document in your file is not a registered instrument, and many tenants assume it is stronger than it is.

When registration is mandatory

  • 12 months or longer: registration is compulsory. An unregistered long lease is not properly admissible as evidence of its own terms, which leaves whoever needs to prove those terms exposed.
  • Under 12 months: not mandatory. Stamping and typically notarisation are enough, though you can still register if you want the extra weight.

The term you pick decides the compliance you owe. That is the whole rule.

Stamp duty and registration charges

Two separate costs, and both vary by state.

Stamp duty is calculated on the rent, or the deposit, or both, together with the lease term, under your state's stamp law. Longer terms attract higher duty, and many states now allow e-stamping.

The registration fee is a separate charge payable when you register at the sub-registrar's office.

Because the slabs differ across states, check your state's stamp and registration department, many of which publish online calculators, before you fix the term and the deposit rather than after.

How registration works

  1. Draft the agreement with the terms spelled out: parties, property, rent, deposit, term, lock-in, maintenance, notice period, and who is responsible for what.
  2. Pay stamp duty through e-stamp paper or the state portal, for the correct value.
  3. Attend the sub-registrar's office β€” both parties and two witnesses β€” or use the online registration facility where your state offers one.
  4. Verify identities with Aadhaar or PAN and photographs as required.
  5. Pay the registration fee and complete the biometric and registration formalities.
  6. Collect the registered agreement, or download it where the process is fully digital.

Several states now run rent-agreement registration entirely online, which removes the physical visit altogether.

What a properly executed agreement buys you

A written, adequately stamped agreement β€” registered too, for a long term β€” is your evidence when something goes wrong. A deposit dispute, an early eviction, unpaid rent, an argument about who pays for repairs.

An unstamped or under-stamped agreement may not be accepted as evidence at all, and an oral tenancy is a dispute waiting for a trigger. For a tenant, the document proves the terms and protects the deposit. For a landlord, it proves the rent, the term and the right to recover possession.

Police verification

Many states require the landlord to complete police verification of the tenant, usually through an online tenant-verification portal or at the local station.

It protects the landlord from liability, and where it is mandatory, skipping it can attract a penalty. Treat it as part of onboarding a tenant rather than as an optional courtesy.

The Model Tenancy Act, 2021

India's rent-control laws are an old patchwork, and the central government released the Model Tenancy Act, 2021 for states to adopt or adapt.

It introduces a written-agreement requirement, caps on security deposits β€” commonly suggested at a couple of months' rent for residential tenancies β€” a Rent Authority for registration, and faster dispute resolution through Rent Courts.

Adoption is state by state, so whether and how any of it applies to you depends entirely on where the property is.

A worked example

A tenant and landlord agree on a flat at β‚Ή25,000/month with a β‚Ή1,00,000 deposit, on an 11-month term.

They draft a clear agreement, pay the applicable stamp duty by e-stamp, have it notarised, and the landlord completes online police verification of the tenant. Because the term is under 12 months, no registration is needed.

Every term is nonetheless in writing and properly stamped, so the deposit and the rent are provable if anything goes wrong. Had they wanted a 2-year lease instead, the same agreement would have had to be registered, with the registration fee on top.

Common mistakes

  • Relying on an oral or unstamped agreement, which may not hold up as evidence.
  • Signing a lease of 12 months or more and not registering it. Registration is not optional at that length.
  • Under-stamping to save money, which can make the document inadmissible.
  • Skipping police verification in a state that requires it.
  • Leaving the deposit and notice terms vague. Those two clauses generate most of the disputes.
